Section 53 (3) of the Freedom of Information and Protection of Privacy Act states:
(3) The failure of the head of a public body to respond in time to a request for access to a record is to be treated as a decision to refuse access to the record, but the time limit in subsection (2) (a) for delivering a request for review does not apply.

The WCB FOI Office received my request under the Freedom of Information Act for disclosure on _____________________ (attached) and acknowledged receipt on _____________________ (attached) noting _____________________ as the date I should expect to receive disclosure.

The Boards letter of _____________________ indicated that part of my request for access to information had been deferred to the Boards Records Management Department, which does not release the Board from its requirement to respond in compliance with the Freedom of Information and Protection of Privacy Act.
